Smiley Flag WaverThe United States Supreme Court, in Boy Scouts of America v. Dale, recognized that the Scout’s policy was an exercise of expressive association protected by the First Amendment. In the aftermath of Dale, the City of Berkeley demanded that the Sea Scouts repudiate its association with BSA’s policy and, when the Sea Scouts’ failed Berkeley’s litmus test, the City stripped the Sea Scouts of the free berth extended to public service organizations. The California Supreme Court rejected the Sea Scout’s claim that Berkeley’s decision to strip them of free berths violated their First Amendment right to expressive association.

“It is disappointing that the Supreme Court did not take this opportunity to reverse an outrageous example of how homosexuals use the powers of government to discriminate against an outstanding youth group in order to force compliance with their worldview on sex, marriage and religion.”

Thomas More Law Center Decries Supreme Court Refusal To Review Decision Penalizing Sea Scouts For Policy Excluding Gays And Atheists


ANN ARBOR, MI – The Thomas More Law Center, a national public interest law firm based in Ann Arbor, Michigan, expressed its disappointment that last week the United States Supreme Court declined to review a California Supreme Court decision allowing the City of Berkeley, CA to deprive the Sea Scouts of free berthing privileges given to other nonprofit organizations because the Sea Scouts refused to repudiate their association with the Boy Scouts of America and its policy requiring exclusion of gays and atheists.

The Sea Scouts are a public service organization that serves local youth by teaching them to sail and learn other skills such as carpentry and plumbing. It is associated with the Boy Scouts of America and must abide by BSA’s policy excluding gays and atheists.

The Law Center had filed a friend of the court brief urging the U.S. Supreme Court to review the case of Evan v. City of Berkeley. The Law Center’s brief argues that Berkeley’s decision to strip the Sea Scouts of a benefit extended to other public service organizations because the City disagrees with BSA’s policy places an unconstitutional condition on receipt of public benefits that violates the First Amendment.

Patrick T. Gillen, the Thomas More Law Center attorney who authored the brief, observed that Berkeley’s policy is a blatant effort to penalize the Sea Scouts for an exercise of their First Amendment rights. “The Supreme Court’s decision lets a truly tragic injustice stand. In this case militant homosexual activists have victimized the underprivileged in a vindictive effort to punish anyone associated with the Boy Scouts of America.”

Gerry Studds had to die for NBC Nightly News to inform viewers of how the former Democratic Congressman had a sexual relationship with 17-year-old male congressional page, misconduct for which the House in 1983 censured him, but did not prompt Democratic House Speaker Tip O'Neill and other leaders to force his resignation -- nor raise calls for O'Neill's resignation. Despite the Democratic hypocrisy given their current calls for Speaker Hastert's resignation and investigations of who knew what and when about Mark Foley, Saturday night -- two weeks into the media-fueled scandal -- was the first time, according to Nexis, any NBC News program mentioned Studds' name.

Anchor John Seigenthaler, who called Studds "Gary," relayed how "from Massachusetts comes word of the death of former Democratic Congressman Gary Studds, the first openly gay Member of Congress." Seigenthaler then gave the gentlest of descriptions as he avoided the word "sexual" in his one sentence on the matter: "In 1983 the House of Representatives censured Studds for his relationship with a teenage page."

ABC does not produce an evening newscast on Saturdays during college football season and college football bumps the CBS Evening News on Saturdays in the Eastern and Central time zones.

As I recall, early in the week of October 2, the ABC and CBS evening newscasts made very brief mentions of the 1983 cases of Democrat Studds, who went on to repeatedly win re-election, and Republican Dan Crane, who also had a sexual relationship with a 17-year-old congressional page -- but a girl -- and lost in his next primary. CNN's Jeff Greenfield put together a full story on Studds, Crane and the history of sexual scandals on Capitol Hill.

The brief item on the October 14 NBC Nightly News, as announced by anchor John Seigenthaler:

"From Massachusetts comes word of the death of former Democratic Congressman Gary [sic] Studds, the first openly gay Member of Congress. In 1983 the House of Representatives censured Studds for his relationship with a teenage page. Still, he won re-election until his retirement in 1997. Studds collapsed last week and was recovering in Boston at a hospital when doctors say he succumbed to a blood clot. Gary Studds was 69."

The Boston Globe's obituary for Studds, on Sunday's front page, noted: "As the Foley scandal unfolded and he abruptly resigned from the House, Republicans in Washington accused Democrats of hypocrisy, saying they had not spoken out in 1983 when Studds was censured. At the time, he called it 'a serious error,' but refused to resign."

[Oh, and on the Harry Reid scandal, zilch again Friday on the three broadcast network evening newscasts: CBS gave 15 seconds to the report of an investigation about a 1996 camping trip in which Congressman Jim Kolbe accompanied some former congressional pages and ABC, which allocated nearly two minutes to the guilty plea from former Congressman Bob Ney, spent about 15 seconds on Congressman John Shimkus appearing before the ethics committee. NBC gave about 25 seconds to Ney, but nothing to any Foley-related matter.]

Wal-Mart Sponsors Diversity Week, Includes How To Defeat A Constitutional Ban On Homosexual Marriage


Wal-Mart has given its full endorsement to the homosexual agenda and homosexual marriage. Boise State University in Boise, Idaho, will observe LGBT Diversity Week October 9-13. One of the sponsors for the Diversity Week is Wal-Mart.

Wal-Mart is joining the Pleasure Boutique (an adult bookstore which bills itself as "Idaho's largest selection of adult movies and DVDs and largest adult toy selection in Idaho") and other groups in sponsoring the week. Diversity Week is a week of celebrating homosexuality and promoting the homosexual agenda and homosexual marriage.

Among the events being sponsored by Wal-Mart is Idaho Votes No Campaign Update and Information Workshop. Voters in Idaho will be voting on a constitutional amendment banning same sex marriage in November. This Wal-Mart sponsored event will inform voters how to oppose the amendment and how to get others to do so. Wal-Mart is putting their money behind the effort to legalize homosexual marriage.

Other events being sponsored by Wal-Mart: Gay History of Idaho, Diversity in the Workplace, Women's/Lesbian Issues, Hate Based Crimes, Heterosexism, Homosexuality and Disabilities, LGBT Youth in Trouble, MCC-Faith and LGBT, and a youth dance for those age 24 and under.

We earlier reported on Wal-Mart throwing their clout and cash behind the homosexual marriage effort.
